Local environmental group, Weald Action Group, was challenging Surrey County Council's decision to give permission for an oil development near Gatwick Airport. They argued that the council failed to consider the further impact of burning over three million tons of oil that will be taken from the site in its environmental impact assessment. On Thursday, the Supreme Court judges sided with the campaigners. They ruled in a 3-2 decision that it was unlawful that the council did not include an assessment of the emissions resulting from the eventual use of the extracted oil. UK laws require this assessment before it can give planning permission. “The council's failure to assess the effect on climate of the combustion of the oil that would be produced from the proposed well site means that its decision to grant planning permission for the project was unlawful,” said Judge George Leggatt.
