PALM BEACH, Florida, April 23, 2020 /PRNewswire/ -- The Orphan Drug Designation program provides orphan status to drugs and biologics which are defined as those intended for the treatment, prevention or diagnosis of a rare disease or condition, which is one that affects less than 200,000 persons in the US or meets cost recovery provisions of the act. The loophole was that since these are small percentages of prospective patients, it is hard for developers to recoup the cost of research, so the companies were granted a 7 year exclusivity, but the Congress reaffirmed and recognized the need to continue supporting research and development for rare diseases.
